1. Who we are

HitzScore (“HitzScore”, “we”, “us”) is operated by HitzScore, a sole proprietorship based in Los Angeles County, California, United States. You can reach us at support@hitzscore.com.

By creating an account or using hitzscore.com (the “Service”), you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the Service.

2. What the Service does

You upload a recording and, optionally, lyrics. HitzScore listens to the recording and reads the lyrics using artificial-intelligence models, scores the song on a number of musical and lyrical traits, and shows you how those scores compare with our library of real Billboard hits that were graded the same way. We may add, change or retire features at any time.

3. Grades are opinions, not guarantees

A HitzScore is an automated assessment generated by AI. It is not a prediction, a promise, or professional advice. Two gradings of the same song can differ, and a high score does not mean a song will chart, sell, be signed, or succeed in any way. You are responsible for every decision you make based on a grade. We do not guarantee the accuracy, completeness or consistency of any score, comment, comparison or report.

4. Your songs stay yours

You keep every right in the recordings, lyrics and other material you submit (“Your Content”). You give us only the limited permission we need to run the Service: to store Your Content, process it with our AI providers to produce your grade, show the results to you, and keep the grade and lyrics transcript in your account. We do not use Your Content to train AI models, and we do not share it with other members or the public. Audio files are processed and are not kept after grading.

You promise that you have the right to submit Your Content – that it is your own work, or that you have permission from whoever owns it – and that it does not infringe anyone else’s rights.

5. Accounts and age

You must be at least 13 years old to use the Service. If you are between 13 and 17, you may use HitzScore only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use, including any purchases. Keep your sign-in details to yourself; you are responsible for activity on your account. One person, one account.

6. Free use, plans and credits

• Free use. We may offer a free allowance of grades. We can change or withdraw it at any time.
• Credits. A paid credit buys one complete grade: the three listens, the lyric scores, the comparison and the printable report. A credit is used the moment a grade runs.
• Credit packs are paid once. Pack credits never expire.
• Monthly plans include a number of grades each billing month and renew automatically until cancelled. Unused plan grades do not roll over to the next month. You can cancel at any time and the plan runs to the end of the period already paid for.
• Prices are shown on the Pricing page in US dollars and may change; a change never affects credits you have already bought.
• Payments are handled by Stripe. We never see or store your card number.

Refunds are covered by our Refund Policy.

7. Acceptable use

Please do not: upload material you have no right to use; upload anything unlawful, hateful or harmful; try to break, overload, scrape or reverse-engineer the Service; resell grades or run them for other people as a business without our written agreement; or use the Service to build a competing product. We may suspend or close accounts that break these rules, and may refuse service to anyone.

8. Our content

The HitzScore name, site, design, grading method, trait definitions, Billboard comparisons and reports belong to us or our licensors. You may use your own grades and reports for any personal or professional purpose, including showing them to others. Billboard® chart data is used for comparison only; HitzScore is not affiliated with or endorsed by Billboard.

9. Availability

We aim to keep the Service running but do not promise uninterrupted or error-free operation. We may pause grading for maintenance or when our AI providers are unavailable. If a grade fails to complete, the credit is not consumed.

10. Limitation of liability

The Service is provided “as is”. To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits, opportunities or goodwill, arising from your use of the Service or reliance on any grade. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

11. Ending the agreement

You can close your account at any time by emailing support@hitzscore.com; we will delete your account and grades as described in the Privacy Policy. We may suspend or close your account if you break these Terms. Unused pack credits on an account closed for breach are not refunded.

12. Changes to these Terms

We may update these Terms. If a change matters, we will post a notice on the site or email you before it takes effect. Continuing to use the Service after that means you accept the new Terms.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Los Angeles County, California, and you agree to their jurisdiction. Before going to court, both of us agree to try in good faith to resolve the matter by email first.
